Your company occupies a rental premises and the owner has informed you that important construction work affecting the structure of the building and also the premises will be carried out. What can you do in this situation?

The construction work will last several months and, furthermore, since your premises will be affected, you may not be able to carry out your activity there for a while. Therefore, you want to know what your rights are in this case.

Well, in these types of situations, the tenant –your company, in this case– has, according to the law, the right to suspend or even withdraw from the rental without any compensation, provided that it has not been agreed otherwise in the contract and the following requirements are met:

• The construction work must be necessary to keep the premises in a condition to be used (as is the case here, since it involves structural reinforcement work), or they must have been required by the Public Administration.
• Furthermore, it is necessary that such construction work prevents the activity for which the premises were rented from being carried out. This will happen if, for example, you have to close the premises for a while.

Therefore, if such requirements are met, you may choose to:

• The suspension. If you choose to suspend the contract, you will not have to pay rent while the construction work lasts, nor will the agreed duration period run.
• The withdrawal. If you ultimately prefer to withdraw, you may terminate the contract without having to pay any compensation to the owner.
